By accessing or using the Brainbeans Pty Ltd website, mobile application, or any services we provide (collectively the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must not use our Platform or services.
Brainbeans Pty Ltd ("Brainbeans", "we", "us", "our") provides online tutoring, test-preparation programs, and related educational services for NSW Opportunity Class, Selective School, and other academic exams. ABN: 32667862848. Contact: info@brainbeans.com.au.
We offer: (a) Access to online practice tests in Mathematics, Reading, Thinking Skills, and Writing; (b) Subscription packages granting time-limited or test-limited access to our learning platform; (c) Optional one-on-one tutoring sessions booked separately; (d) Progress tracking and performance analytics; (e) AI-powered tutoring assistance; (f) Access to past exam papers and educational resources.
Our services are designed for students preparing for NSW educational exams. Users under 18 must have parental or guardian consent. By registering, you confirm that you have the authority to bind yourself (or your child) to these Terms.
You must provide accurate, current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
We offer various subscription packages (Free, Silver, Gold) with different access levels and durations. Package details (including test limits, duration, and features) are displayed at the time of purchase. Subscriptions are non-transferable.
All prices are in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change, but changes will not affect existing subscriptions.
Payment must be made in full at the time of purchase unless otherwise agreed. We accept credit/debit cards and other payment methods as displayed. Failed or declined payments may result in service suspension.
Some subscriptions may auto-renew. You will be notified before renewal and can opt out via your account settings.
Please refer to our separate Refund & Cancellation Policy for detailed information. In summary: Free packages are non-refundable. Paid packages may be eligible for refunds under our 30-day money-back guarantee (subject to conditions). Tutoring sessions have specific cancellation requirements.
You agree to: (a) Use the Platform only for lawful, educational purposes; (b) Not share your login credentials with others; (c) Not copy, distribute, or reproduce our content without permission; (d) Not attempt to hack, disrupt, or damage the Platform; (e) Not use automated tools (bots, scrapers) to access the Platform.
You must not: (a) Upload malicious code or viruses; (b) Harass, abuse, or threaten other users or staff; (c) Use the Platform to cheat on actual exams; (d) Engage in any activity that violates Australian law.
All content on the Platform (including text, graphics, tests, questions, videos, and software) is owned by Brainbeans or our licensors. You are granted a limited, non-exclusive, non-transferable license to access and use our content for personal, educational purposes only. You may not copy, modify, distribute, sell, or create derivative works without our written permission. Unauthorized use may result in account termination and legal action.
If you submit content (e.g., comments, feedback), you grant us a worldwide, royalty-free license to use, reproduce, and display such content. You must not submit content that is offensive, defamatory, or infringes third-party rights.
We are committed to protecting your privacy. Please review our Privacy Policy for details on how we collect, use, and protect your personal information. By using our Platform, you consent to our data practices as described in the Privacy Policy.
To the maximum extent permitted by law: (a) We provide the Platform "as is" without warranties of any kind; (b) We do not guarantee specific exam results or academic outcomes; (c) We are not liable for any indirect, incidental, or consequential damages; (d) Our total liability to you will not exceed the amount you paid for the services in the past 12 months. Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law.
Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. If we fail to meet these guarantees, you may be entitled to a remedy. Nothing in these Terms limits your rights under the Australian Consumer Law.
Our Platform may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party services is at your own risk.
We may suspend or terminate your account if you: (a) Violate these Terms; (b) Engage in fraudulent activity; (c) Fail to pay fees owed. You may terminate your account at any time via your account settings or by contacting us. Upon termination, you will lose access to your account and any purchased content.
We may update these Terms from time to time. We will notify you of material changes via email or Platform notification. Continued use after changes constitutes acceptance of the new Terms.
If you have a complaint, please contact us at info@brainbeans.com.au. We will attempt to resolve disputes informally. If we cannot resolve the issue, you may escalate to an external dispute resolution service or seek remedies under Australian law.
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of NSW.
